Terms of Service
Effective date: October 21, 2026
Welcome to TopTen. These Terms of Service (“Terms”) explain the rules for using the TopTen website and service (“TopTen,” “we,” “us”). By creating an account or using TopTen, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use TopTen.
1. What TopTen is
TopTen lets you make and share ranked lists of your favorite things (movies, shows, books, music, places, quotes, photos, gift ideas and more), see other people's lists, follow people, add friends, and react to and comment on lists. You can choose whether each list is public, friends-only, or private.
2. Who can use TopTen
You must be at least 13 years old to use TopTen. If you are under the age of majority where you live, you may only use TopTen with the permission of a parent or guardian. By using TopTen you confirm that you meet these requirements.
3. Your account
- You need an account to create lists, follow people, add friends, comment, or react. Give accurate information and keep your password secure. You're responsible for activity on your account.
- We ask you to verify your email address before you can post or connect with others.
- Your username and profile (name, bio, photo) are public.
- One person per account. Don't impersonate anyone or create accounts to get around a suspension.
4. Your content
“Your content” means anything you post: lists, list items and notes, photos, comments, reactions, and profile information.
- You own your content. TopTen does not claim ownership of it.
- License to TopTen. So we can run the service, you give TopTen a worldwide, non-exclusive, royalty-free license to host, store, copy, display, format and share your content on TopTen and in previews of TopTen links (for example, a link preview when you share a list), according to the visibility you choose. This license ends when you delete the content, except for brief backup copies and content others have already shared or copied.
- Visibility. Public lists can be seen by anyone, including people who aren't signed in and search engines. Friends-only lists can be seen by you and your accepted friends. Private lists are for you only. Anyone who can see a list can also see its comments and reactions.
- You're responsible for what you post. Only post content you have the right to share, including photos.
- We may remove content or limit visibility if we believe it breaks these Terms or the law.
5. Things you may not do
- Harass, bully, threaten, or abuse anyone, or post hateful, sexually explicit, or violent content.
- Post anything illegal, or content that infringes someone else's copyright, trademark, privacy, or other rights.
- Spam, scam, or mislead people, or post malware or harmful links.
- Scrape, crawl, harvest, or copy TopTen's content or users' data by automated means (bots, scripts, scrapers), except search engines indexing public pages under our robots.txt rules.
- Copy, reproduce, or imitate TopTen's design, look and feel, code, text, or other content, or build a competing service from it.
- Try to access accounts, lists, or data you aren't allowed to see, or get around TopTen's security or privacy settings.
- Interfere with or overload the service, or reverse-engineer it except as the law allows.
- Use TopTen for any unlawful purpose.
6. TopTen's property
TopTen, including its website, software and code, design, look and feel, graphics, curated content (such as seasonal lists), and the TopTen name and logo, belongs to TopTen's operator and is protected by intellectual-property laws. These Terms don't give you any right to use our name, logo, or brand. You may share links to TopTen pages.
7. Affiliate links and third-party sites
Some links on TopTen, such as gift-idea shopping links, may be affiliate links. If you buy something after clicking one, TopTen may earn a commission, at no extra cost to you. Links to other websites (for example, stores, IMDb, or links people add to their lists) take you to sites we don't control. We aren't responsible for their content, products, or privacy practices.
8. Ending your use
You can stop using TopTen at any time, and you can delete your lists and comments yourself. You can delete your account yourself from Edit profile (“Delete my account”). For help, contact us using our contact form. We may suspend or end your access, or remove content, if you break these Terms, if required by law, or to protect TopTen or its users. Sections 4 (license for content already shared), 6, 9, 10, and 12 continue after your account ends.
9. Disclaimers
TopTen is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't promise the service will be uninterrupted, error-free, or secure, or that content will always be available or accurate. Content posted by users reflects their own views, not TopTen's.
10. Limitation of liability
To the fullest extent the law allows, TopTen and its operator won't be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of (or inability to use) TopTen. Our total liability for any claim relating to TopTen is limited to the greater of the amount you paid us in the past 12 months (TopTen is currently free) or US $50. Some places don't allow these limits, so they may not fully apply to you.
11. Changes to these Terms
We may update these Terms from time to time. If we make important changes, we'll update the effective date above and may let you know on the site. If you keep using TopTen after changes take effect, you accept the updated Terms.
12. Governing law
These Terms are governed by the laws of the United States and the state where TopTen's operator resides, without regard to conflict-of-law rules.
